CNN: South Dakota abortion ban going down

Challenge to Roe v. Wade is headed for defeat.

CNN projects that a measure in South Dakota, which would ban nearly all abortions, is going down in defeat. If the law had passed, it would have outlawed all abortions, without exception for rape or incest, except those necessary to save the life of the mother. Under the law, a woman would not have been prosecuted for terminating a pregnancy, but anyone who helped her to receive one could be charged with a felony, carrying a sentence of up to five years in prison.

The South Dakota Legislature passed the ban last spring, which was signed into law by the governor in March, in hopes of the hopes of taking it to the U.S. Supreme Court to overturn Roe v. Wade, the landmark 1973 ruling legalizing abortion. But abortion-rights activists took the issue to the voters in South Dakota, and, according to CNN, they appear to have prevailed.
