"The painful but necessary imperfection of compromise" means LGBT immigrants are excluded from immigration reform

“I believe, in my heart of hearts, that what you’re doing is the right and just thing, but I believe this is the wrong moment, and this is the wrong bill.” That was Sen. Dick Durbin yesterday, one of several Democratic senators who wistfully explained -- some of them even convincingly -- why a provision allowing binational gay couples to reunite under immigration reform shouldn’t even be voted on. Republicans, notably Lindsey Graham and Jeff Flake, were openly threatening to sink a bill with LGBT provisions, risking the unbroken momentum of immigration reform. Indeed, the bill was successfully voted out of committee. All those "Lincoln" screenings in Washington last year have evidently sunk in, because Tony Kushner couldn’t have scripted it better.

The party has a golden chance to make inroads with Latinos and gays with one immigration move. And it's blowing it

From a pure political perspective, supporting inclusion of same-sex couples in the immigration reform bill should be a slam dunk for both Democrats and Republicans. Scuttling the package over this provision would alienate the growing Latino constituency by blocking a pathway to citizenship -- and denying rights to LGBT Americans would be ignoring the direction of the country on civil rights.

And yet, according to a flurry of news stories from the past couple of weeks, the die is apparently cast on the matter: Allowing some 30,000 same-sex couples the same access to green cards that opposite-sex couples enjoy will halt the bill for 11 million immigrants. Even before the provision has been debated or a vote count begun, Republicans are holding firm to a position that’s literally killing their party. Meanwhile, Democrats run scared, to the detriment of the overall bill.

In plain English: The Republicans need this bill because their party doesn’t have a future if they can’t appeal to Latino voters. On the flip side, Democrats shouldn’t be sacrificing any progressive priorities before the horse-trading even begins because the more they start with, the more they will be able to keep in the end.

Monday's Senate hearings on immigration reform got a little fiery when Sen. Chuck Grassley interrupted proceedings to insist that he never suggested delaying immigration reform over the Boston bombings. "I never said that!" he exclaimed to Sen. Chuck Schumer.

Schumer was giving a statement on the bill, and said that Americans "will not be satisfied with calls for delays and impediments towards the bill. I would say to my colleagues - and I understand their views are heartfelt - the chairman has a very open process, so if you have ways to improve the bill, offer an amendment." He continued: "Those who are pointing to the terrible tragedy in Boston as, I would say, an excuse for not doing a bill or delaying it many months or year--"

Grassley interrupted: "I never said that! I never said that!"

Schumer shot back: "I didn't say you did sir!" Once order was restored, Schumer continued: "Those remarks were not aimed at anyone on the committee or the three witnesses. There were people out there, you read it in the newspapers, who have said it."

Watch:

When President Barack Obama first introduced his principles for immigration reform a little over two months ago, one notable point of differentiation from the Senate’s framework was that he chose to include same-sex couples and their kids in his plan.

As Stephen Colbert noted on "The Colbert Report," the president’s plan said it would treat “same-sex families as families.”

“What’s next, Mr. President,” Colbert jested, “treating gay people as people?”

But now that the Senate’s Gang of Eight has introduced its immigration bill and it notably excludes the provision that would allow U.S. citizens to sponsor their same-sex partners for residency, the White House appears to be wavering.

When asked last week whether the president was willing to “let that provision go” at a White House briefing, press secretary Jay Carney responded, “It is certainly the case, as the president said in his statement, that not everything in the bill reflects how he would write it, but it broadly is consistent with his principles.”

Sens. Pat Toomey and Joe Manchin gave a press conference on Wednesday announcing a bipartisan deal on universal background checks. But two other senators, Chuck Schumer and Mark Kirk, who also worked extensively on the deal, were noticeably absent. Reportedly, it was because Toomey refused to appear with Schumer.

Meredith Shiner of Roll Call reports:

Toomey, the former Club for Growth president, had told Manchin he would not speak at the news conference if he had to get on stage with Schumer, according to two sources familiar with the talks. Schumer obliged, and Kirk also agreed not to appear in order to provide cover to Schumer.

“Manchin and Toomey are the best people to sell this agreement to the pro-gun community, and Schumer doesn’t want to get in the way of that. His job is to persuade the gun safety groups that it’s an acceptable deal,” a Democratic aide said of the group’s dynamic.

According to Shiner, there were fears on both sides of the aisle that Schumer would become the senator most closely associated with the bill, which would hurt the bill's chances of pulling in conservative support.

The bipartisan agreement could build support for Obama's latest push to curb gun violence

WASHINGTON (AP) — A bipartisan deal seems imminent on expanding background checks to more gun buyers, an agreement that could build support for President Barack Obama's drive to curb firearms violence.

Meanwhile, the Senate is ready for an opening vote on restricting guns as Majority Leader Harry Reid, D-Nev., set a roll call for Thursday on starting consideration of the firearms legislation. Odds are growing that Democrats will win enough Republican support to thwart an effort by conservatives and Senate Minority Leader Mitch McConnell, R-Ky., to block consideration from even starting.

"I hope Republicans will stop trying to shut down debate and start engaging in the tough issues we were sent to Washington to tackle," Reid said.

Together, the developments were a boost for gun control advocates battling for restrictions in the wake of December's shootings that killed 20 first-graders and six staffers at an elementary school in Newtown, Conn.

Even so, the ultimate fate of gun legislation remains unclear, clouded by opposition from many Republicans and moderate Democrats in the Democratic-led Senate and the Republican-run House. Many critics say the proposal would violate the Second Amendment right to bear arms and burden law-abiding gun owners.

The brightest spot of news was on immigration reform. Over the weekend, we heard that "labor and business" (that is, the AFL-CIO and the U.S. Chamber of Commerce) had reached a mutually agreeable compromise on guest workers. On Sunday, "Gang of Eight" member Chuck Schumer all but promised that reform would happen, and happen soon. Then, Sen. Marco Rubio, a member of that gang, publicly announced his intention to slow everything down.

Rubio sent a letter to Senate Judiciary Committee Chairman Pat Leahy in which he demanded more hearings. So, so many hearings. (Rubio's letter contained the word "hearings" six times.) And open amendments, which is basically asking permission for anti-reform senators to attempt to make a series of potentially toxic votes if they want their precious reform.

He wants credit with Latinos for brokering an immigration reform deal, and with the Tea Party for slowing it down

It was the mystery left in the wake of the Sunday shows: Just before Sen. Chuck Schumer was set to tell “Meet the Press” that the so-called Gang of Eight is on the verge of a deal on immigration reform, Sen. Marco Rubio sent out a statement headlined, “Rubio: No Final Agreement on Immigration Legislation Yet.” It read, in part, “Reports that the bipartisan group of eight senators have agreed on a legislative proposal are premature."

Schumer went ahead and kvelled about being close to a deal, anyway. “With the agreement between business and labor, every major policy issue has been resolved on the ‘Gang of Eight,’” he told NBC’s Chuck Todd. A GOP Gang member, Sen. Jeff Flake of Arizona, sounded more cautiously optimistic. "We're much closer with labor and business agreeing on this guest-worker plan," Flake told Todd. "But that doesn't mean we've crossed every 'I' or dotted every 'T' or vice versa." They were referring to a deal on the status of low-skilled immigrant workers brokered Friday night by AFL-CIO president Richard Trumka and U.S. Chamber of Commerce head Tom Donohue.

The move paves the way for immigration legislation allowing 11 million illegal immigrants to gain citizenship

WASHINGTON (AP) — Big business and labor have struck a deal on a new low-skilled worker program, removing the biggest hurdle to completion of sweeping immigration legislation allowing 11 million illegal immigrants eventual U.S. citizenship, labor and Senate officials said Saturday.

The agreement was reached in a phone call late Friday night with AFL-CIO President Richard Trumka, U.S. Chamber of Commerce head Tom Donohue, and Democratic Sen. Chuck Schumer of New York, who's been mediating the dispute.

The deal resolves disagreements over wages for the new workers and which industries would be included. Those disputes had led talks to break down a week ago, throwing into doubt whether Schumer and seven other senators crafting a comprehensive bipartisan immigration bill would be able to complete their work as planned.

The deal must still be signed off on by the other senators working with Schumer, including Republicans John McCain of Arizona and Marco Rubio of Florida, but that's expected to happen, according to a person with knowledge of the talks who spoke on condition of anonymity. With the agreement in place, the senators are expected to unveil their legislation the week of April 8. Their measure would secure the border, crack down on employers, improve legal immigration and create a 13-year pathway to citizenship for the millions of illegal immigrants already here.

The delay will give Chuck Schumer and Tom Coburn more time to reach a compromise on background checks

WASHINGTON (AP) — The Senate Judiciary Committee postponed its work Thursday on writing bills curbing guns, probably until next week.

The committee is considering Democratic-sponsored bills that would ban assault weapons, strengthen federal laws against illegal gun trafficking, provide money for school safety improvements and expand the requirement for background checks for gun purchasers.

Such delays are common for the committee, which often grants them to give senators more time to work on legislation. As the panel began discussing the measures Thursday, top Republican Sen. Charles Grassley of Iowa said he had questions about the constitutionality and cost of some of the measures and said senators needed more time to trying working out differences.

NRA-backed Sens. Joe Manchin and Tom Coburn are among the four looking for a bipartisan compromise

A bipartisan group of senators is reportedly making progress on a deal for universal background checks, which could include a way of closing the gun show loophole.

Sens. Chuck Schumer, D-N.Y., and Mark Kirk, R-Ill., who are both "F"-rated by the NRA, and Sens. Joe Manchin, D-W. Va., and Tom Coburn, R-Okla., who are both "A"-rated by the NRA, have been quietly working on a compromise.

CNN reports:

CNN is told the legislation they are working on would effectively require background checks on private gun purchases made with non-licensed gun dealers, according to sources in both parties. That would include closing the so-called gun show loophole.

However, the sources emphasize they are trying to work through this sticky issue so that Republicans, especially Coburn, are comfortable that it would address privacy concerns of gun owners, and would have clear exemptions for situations where a background check should not be needed. The most common example of that scenario is a grandfather or uncle giving guns they already own to a grandson or nephew.

But the House will probably throw cold water on their plans

In a press conference Monday, a bipartisan group of senators rolled out the framework of a new push for immigration reform, with an eye on late spring or summer to introduce legislation. The plan involves a "pathway to citizenship" for illegal immigrants already living in this country, though the pathway is “contingent upon our success in securing our borders and addressing visa overstays.”

"We believe this will be the year Congress finally gets it done," Sen. Chuck Schumer, D-N.Y., said, adding: "For the first time ever, there is more political risk in opposing immigration reform than in supporting it. We believe we have a window of opportunity to act, but we will only succeed if the effort is bipartisan."

Sen. John McCain, R-Ariz., who occasionally flip-flopped on his support for immigration reform, referred to the 11 million undocumented immigrants currently living in the country as "a de-facto amnesty."

"We have been too content for too long to allow individuals to mow our lawn, serve us food, clean our homes and even watch our children while not affording them any of the benefits that make our country so great," he said.

     (updated below - Update II)

Chuck Schumer, the third-ranking Democrat in the U.S. Senate, spoke to an event of Orthodox Jewish leaders on Wednesday and made comments that can only be described as bigoted and disgusting. Kudos to Zaid Jilani who, despite working for the Democratic Party-serving Center for American Progress, wrote about Schumer's remarks on CAP's ThinkProgress blog and explained the reasons they were filled with falsehoods, or -- as he put it -- "as offensive as they are wrong."

Schumer told his audience that the "Palestinian people still don’t believe in the Jewish state, in a two-state solution" and added that "they don’t believe in the Torah, in David." As a result,"you have to force them to say Israel is here to stay." It's the Israeli blockade which accomplishes that, he argued. And Schumer is due some credit for being honest enough (unlike most devoted Israel defenders) to admit that a prime purpose of the blockade has nothing to do with keeping arms away from Hamas, but rather, is to economically strangle the people in Gaza -- meaning not Hamas, but the 1.5 million human beings (men, women and children) who live there:
