According to the criminal complaint against Kadyrbayev and Tazhayakov, the pair recognised Tsarnaev from pictures released by the authorities four days after the attack. Kadyrbayev is said to have told FBI agents that then he sent text messages to Tsarnaev, who replied "Lol", "You better not text me", and "Come to my room and take whatever you want."

The complaint alleges the Kazakh pair then went with Phillipos to Tsarnaev's dorm room at Pine Dale Hall. They were let in by Tsarnaev's unnamed roommate, who told them Tsarnaev had left some hours earlier.

The FBI says the accused men described how, while watching a movie in the room, they noticed a backpack containing seven red tubes of fireworks, emptied of their explosive powder. Kadyrbayev, by now sure of Tsarnaev's involvement in the bombings, admitted to agents that he decided to remove the backpack "in order to help his friend Tsarnaev avoid trouble".

All three suspects have been charged, according to Federal court documents.

The first two suspects, Dias Kadyrbayev and Azamat Tazhayakov, have been charged with conspiracy to obstruct justice for "destroying, concealing, and covering up objects" belonging to Dzhokhar Tsarnaev. The full complaint can be read here.

NBC News' Pete Williams is reporting that the three suspects currently in custody have been under FBI surveillance for more than a week, and while "there was no indication they had any prior knowledge of the bombing" sources told NBC News that "the FBI had been investigating [the suspects] for about 10 days."

The allegations against them were not immediately disclosed. Gov. Deval Patrick, who said he was briefed on the investigation, told reporters it's his understanding that the suspects had nothing to do with the bombings but helped the suspect after the fact.

The body of Tamerlan Tsarnaev, 26, has been at the medical examiner's office in Massachusetts since he died after a gunfight with authorities more than a week ago.

Amato DeLuca, the Rhode Island attorney for his widow, Katherine Russell, said Tuesday that his client had just learned that the medical examiner was ready to release Tsarnaev's body and that she wants it released to his side of the family.

Police said Tsarnaev ran out of ammunition before his brother, 19-year-old Dzhokhar Tsarnaev, dragged his body under a vehicle while fleeing the scene. His cause of death has been determined but will not be made public until his remains are claimed.

"Of course, family members will take possession of the body," uncle Ruslan Tsarni of Maryland told The Associated Press on Tuesday night. "We'll do it. We will do it. A family is a family."

He would not elaborate. Tsarnaev's parents are still in Russia, but he has other relatives on his side of the family in the U.S., including Tsarni.

These questions are timely, following Vice President Joe Biden’s dismissive description of the Boston Marathon bombers as “knockoff jihadis.” Mere amateurs, these brothers, who were capable of murdering several marathon participants, maiming scores more and shutting down a major city and even rail lines for hours or days. The real amateurism, it might be suggested, is that of the pundits and journalists trying to psychoanalyze the Tsarnaev brothers and their relations from a distance.

But there are already reports that Dzhokhar Tsarnaev, the surviving killer, has said that he and his brother acted in response to the U.S. wars in Iraq and Afghanistan — wars that they considered to be attacks on Islam. What if this really was the motive? What if these brothers really were sincere Islamist revolutionaries, like the thousands of others who have rallied to militant jihadism in the past several decades, whether they were connected to international Islamist networks or acting on their own? That doesn’t exonerate their brutal crimes in any way. But surely Islamist terrorists are best understood in terms of the common Islamist ideology they share, rather than personal or familial experiences that are unique to each.

Tsarnaev apparently used the account, @jmaister1, to like a photo of a deceased Chechen warlord. He also liked photos that used hashtags such as #FreeChechenia, #Jihad, #Jannah, #ALLAH, #Jesus, and #God.

While the account is gone, CNN was able to find some of the content posted to it using archiving tools like Google's Web cache.

In its Terms of Service, Instagram says that if subpoenaed, it will turn over users' information. However, it notes that the information might only be stored for a short time due to the volume of content that floods the service.

The U.S. Marshals Service said Friday that Dzhokhar Tsarnaev left Beth Israel Deaconess Medical Center overnight and was taken to the Federal Medical Center Devens about 40 miles west of Boston.

The facility, on the decommissioned Fort Devens U.S. Army base, treats federal prisoners and detainees who require specialized long-term medical or mental health care.

The 19-year-old Tsarnaev is recovering from a gunshot wound to the throat and other injuries suffered during his attempted getaway.

Dzhokhar Tsarnaev immediately stopped talking after a magistrate judge and a representative from the U.S. Attorney's office entered his hospital room and gave him his Miranda warning, according to four officials of both political parties briefed on the interrogation. They insisted on anonymity because the briefing was private.

Before being advised of his rights, the 19-year-old suspect told authorities that his older brother, Tamerlan Tsarnaev, 26, only recently had recruited him to be part of the attack that detonated pressure-cooker bombs at the marathon finish line, two U.S. officials said.

The CIA, however, had named Tamerlan to a terrorist database 18 months ago, said officials close to the investigation who spoke to The Associated Press on condition of anonymity because they were not authorized to discuss the case with reporters.

The new disclosure that Tamerlan Tsarnaev was included within a huge, classified database of known and suspected terrorists before the attacks was expected to drive congressional inquiries in coming weeks about whether the Obama administration adequately investigated tips from Russia that Tsarnaev had posed a security threat.

"My heart goes out to you," Biden told Collier's family. "I hope you find some solace in this time of extreme grief."

Dzhokhar Tsarnaev (joh-KHAHR' tsahr-NEYE'-ehv) had been listed in serious condition at a Boston hospital since he was captured Friday. On Tuesday, the U.S. attorney's office said his condition had been upgraded to fair.

The 19-year-old was wounded in a shootout with police and suffered gunshot wounds in the head, neck, legs and hand.

Tsarnaev was charged Monday in the twin bombings that killed three people and wounded more than 260. His older brother, Tamerlan Tsarnaev, was killed during the shootout.
