Lawyers seek docs on NYPD unit that eyed Muslims

Civil rights attorneys investigate the controversial surveillance program

Civil rights lawyers asked a federal judge Monday to force the New York Police Department to turn over documents about its secret efforts to spy on and infiltrate the Muslim community.

The request, filed in federal court in Manhattan, is based on reporting by The Associated Press, which revealed a clandestine police unit that monitored all aspects of daily life in Muslim neighborhoods. Documents showed that plainclothes officers were being dispatched to eavesdrop inside businesses. Restaurants that serve Muslims were identified and photographed. Hundreds of mosques were investigated. Dozens were infiltrated.

Police also maintained a list of 28 countries that, along with “American Black Muslim,” were labeled “ancestries of interest.”

“Based on this evidence, there is reason to believe that the NYPD retains records of surveillance of public places that are not limited to information pertaining to ‘potential unlawful activity or terrorism,’” lawyers told U.S. District Judge Charles Haight.

A spokesman for the New York Police Department didn’t immediately respond to a message seeking comment.

The documents were filed as part of a decades-old, class-action lawsuit against the NYPD for spying on war protesters and activists. Since 1985, a court order has limited how the department can monitor activities protected by the First Amendment. Police are not allowed to collect and store information about innocent people that is not related to criminal or terrorist activity.

“The (AP) articles, as well as NYPD documents that have been published in conjunction with them, strongly suggest that the NYPD retains such records as a matter of policy,” wrote lawyer Jethro M. Einstein, the lead lawyer in the case.

NYPD spokesman Paul Browne has said police only follow leads and do not trawl neighborhoods. Documents obtained by the AP, however, show a secret team known as the Demographics Unit was instructed to canvass neighborhoods looking for businesses catering to one ethnic group, Moroccans. The documents indicated plans to build databases for other ethnic groups showing where they eat, work, pray and shop.

Current and former officials said those databases made some working in the police department uncomfortable, including in-house lawyer Stuart Parker. Because of those concerns, they said, the Demographics Unit stored its information on a special computer not connected to the department’s normal intelligence database. Lawyers asked Haight to order police not to delete any of those materials.

Haight did not immediately rule on the request.

The same U.S. military unit that got Osama bin Laden used a drone and jet strike in Yemen on Friday to kill an American-born cleric suspected of inspiring or helping plan numerous attacks on the United States, including the Christmas 2009 attempt to blow up a jetliner, U.S. officials said.

Anwar al-Awlaki was killed in a strike on his convoy carried out by a joint operation of the CIA and the U.S. Joint Special Operations Command, according to counterterrorism officials, speaking on condition of anonymity to discuss intelligence. The CIA provided the intelligence and the military provided the firepower.

Al-Awlaki had been under observation for three weeks while they waited for the right opportunity to strike, one of the U.S. officials said.

The cleric known for fiery anti-American rhetoric spread on the Internet was suspected of inspiring the mass shooting at Fort Hood Army base in Texas in 2009 and of taking a more direct role in planning the attempted Christmas bombing of a Detroit-bound jetliner and other terror attempts against Americans.

He is the most prominent al-Qaida figure to be killed since bin Laden’s death in May.

U.S. word of al-Awlaki’s death came after the government of Yemen reported that he had been killed Friday about five miles from the town of Khashef, some 87 miles from the capital Sanaa.

The air strike was carried out more openly than the covert operation that sent Navy SEALs into bin Laden’s Pakistani compound, U.S. officials said.

Counterterrorism cooperation between the United States and Yemen has improved in recent weeks, allowing better intelligence-gathering on al-Awlaki’s movements, U.S. officials said. The ability to better track him was a key factor in the success of the strike, U.S. officials said. Officials spoke on condition of anonymity to discuss intelligence matters.

Al-Awlaki’s death is the latest in a run of high-profile kills for Washington under President Barack Obama. But the killing raises questions that the death of other al-Qaida leaders, including bin Laden, did not.

Al-Awlaki is a U.S. citizen, born in New Mexico to Yemeni parents, who had not been charged with any crime. Civil liberties groups have questioned the government’s authority to kill an American without trial.

U.S. officials have said they believe al-Awlaki inspired the actions of Army psychiatrist Maj. Nidal Hasan, who is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the attack at Fort Hood, Texas.

In New York, the Pakistani-American man who pleaded guilty to the May 2010 Times Square car bombing attempt said he was “inspired” by al-Awlaki after making contact over the Internet.

Al-Awlaki also is believed to have had a hand in mail bombs addressed to Chicago-area synagogues, packages intercepted in Dubai and Europe in October 2010.

Al-Awlaki’s death “will especially impact the group’s ability to recruit, inspire and raise funds as al-Awlaki’s influence and ability to connect to a broad demographic of potential supporters was unprecedented,” said terrorist analyst Ben Venzke of the private intelligence monitoring firm, the IntelCenter.

But Venzke said the terror group al-Qaida in the Arab Peninsula will remain the most dangerous regional arm “both in its region and for the direct threat it poses to the U.S. following three recent failed attacks,” with its leader Nasir al-Wahayshi still at large.

Al-Awlaki wrote an article in the latest issue of the terror group’s magazine justifying attacking civilians in the West. It’s titled “Targeting the Populations of Countries that Are at War with the Muslims.”

Al-Awlaki served as imam at the Dar al-Hijrah mosque in Falls Church, Va., a Washington suburb, for about a year in 2001.

The mosque’s outreach director, Imam Johari Abdul-Malik, has said that mosque members never saw al-Awlaki espousing radical ideology while he was there and that he believes Awlaki’s views changed after he left the U.S.

NYPD eyed U.S. citizens in intel effort

Police reportedly monitored Americans under no suspicion of wrongdoing, simply because of their ethnicity

The New York Police Department put American citizens under surveillance and scrutinized where they ate, prayed and worked, not because of charges of wrongdoing but because of their ethnicity, according to interviews and documents obtained by The Associated Press.

The documents describe in extraordinary detail a secret program intended to catalog life inside Muslim neighborhoods as people immigrated, got jobs, became citizens and started businesses. The documents undercut the NYPD’s claim that its officers only follow leads when investigating terrorism.

It started with one group, Moroccans, but the documents show police intended to build intelligence files on other ethnicities.

Undercover officers snapped photographs of restaurants frequented by Moroccans, including one that was noted for serving “religious Muslims.” Police documented where Moroccans bought groceries, which hotels they visited and where they prayed. While visiting an apartment used by new Moroccan immigrants, an officer noted in his reports that he saw two Qurans and a calendar from a nearby mosque.

It was called the Moroccan Initiative.

The information was recorded in NYPD computers, officials said, so that if police ever received a specific tip about a Moroccan terrorist, officers looking for him would have details about the entire community at their fingertips.

The documents show how New York’s rich heritage as a place where immigrants traditionally have blended in and built their lives now clashes with today’s New York, where police see blending in as one of the first priorities for would-be terrorists.

To prevent attacks, police monitored the path that generations of immigrants followed: getting an apartment, learning English, finding work, assimilating into the culture. Activities such as haircuts and gym workouts were transformed from mundane daily routines into police data points.

A U.S. citizen in Queens, for example, starts work each day at what police labeled “a known Moroccan barbershop.”

The AP previously revealed the secret operations of the NYPD intelligence division as it mapped the Muslim community in and around New York, monitored life in ethnic neighborhoods and scrutinized mosques. The Moroccan Initiative was one of the division’s projects.

Such programs began with help from the CIA under President George W. Bush and have continued with at least the tacit support of President Barack Obama, whose administration repeatedly has sidestepped questions about them. It is unclear whether Mayor Michael Bloomberg oversaw the programs. He has refused to comment directly about them.

In response to the AP’s earlier stories, the CIA’s inspector general is investigating whether its unusually close relationship with the NYPD was unlawful.

NYPD spokesman Paul Browne did not return messages seeking comment about the Moroccan Initiative. In an earlier email, he said the department was not involved in wholesale spying, but rather was trying to document the likely whereabouts of terrorists.

“The unit’s personnel would try to establish, for example, what border crossing a terrorist entering New York would use, what flop house he’d use, what Internet cafe he’d frequent to communicate, etc.,” he wrote.

It’s unclear exactly when the initiative began and whether it continues in any form. Current and former officials told the AP that it started in response to the 2003 suicide bombings that killed 45 people in the Moroccan city of Casablanca and the 2004 train bombing in Madrid that was linked to Moroccan terrorists.

In early meetings, police were told there was no specific threat to New York from Moroccans, officials said, but they were instructed to gather intelligence on the Moroccan community because of concerns Moroccan terrorists might strike here too.

NYPD intelligence chief David Cohen, a former senior CIA officer, oversaw the program, current and former officials said. Many of the documents obtained by the AP were prepared for Police Commissioner Ray Kelly but because of the volume of such documents his office receives, it’s unclear whether he read them.

New York City law prohibits police from using race, religion or ethnicity as “the determinative factor” for any law enforcement action. Civil liberties advocates have said that is so ambiguous it makes the law unenforceable. The NYPD has said intelligence officers do not use racial profiling or troll ethnic neighborhoods for information.

The documents obtained by the AP, many of which were marked “secret,” include a list of “Moroccan Locations,” a virtual tour of the city’s Moroccan neighborhoods. Photos of local businesses were accompanied by notes from plainclothes officers, known as rakers, who quietly kept tabs on ethnic neighborhoods and eavesdropped on conversations.

“A lot of these locations were innocent,” said an official involved in the effort, who like many others interviewed by the AP spoke only on condition of anonymity to discuss sensitive police operations. “They just happened to be in the community.”

Sometimes the notes recorded in police files were detailed, such as the officer who reported that a local sandwich shop was close to a mosque and said the store was closed during Friday prayers.

“The restaurant serves only Halal meat,” the document said. “The majority of the customers are religious Muslims.”

Halal meat is prepared under religious rules similar to kosher food.

Other businesses were described with fewer details. But in every case, the officers noted the ethnicity of the owners.

“In America, you don’t put people under suspicion without good reason,” said Rep. Rush Holt, D-N.J., who reviewed some of the documents obtained by the AP and has urged the Justice Department to investigate. “The idea that people in a group are suspect because of being members of a group is profiling, plain and simple.”

Business owners in the Astoria neighborhood of Queens, where many of the pictures were taken, at first expressed amusement at seeing themselves alongside their friends and neighbors in documents compiled by officers hunting for terrorists.

“Police come here for what? We cut hair all day,” said Amine Darhbach, a U.S. citizen barber who charges $12 for a haircut and sends a portion of his earnings to his family in Morocco each month.

As they flipped through the documents, they said they grudgingly accepted the police attention. It is hardly news to them that, since the 2001 terrorist attacks, Muslims are under greater scrutiny by the public and law enforcement.

“We’ve been harassed for so long, it doesn’t make any sense to complain,” said Leo Santini, a cafe owner and U.S. citizen who changed his name from Mohamed Hussein because he thought he would be treated better without such an Arab name. His three American kids, he said, “don’t look Arab, so they won’t have any problems.”

Finally, there was frustration and anger about being included in police documents.

“All I want is the best for my daughter and my community and to be treated like a new American citizen,” said Sanaa Bergha, whose travel agency was among the businesses photographed in the intelligence files.

Like others, Bergha said that, if asked, she would talk to police about how she could help keep the city safe. But she’s only spoken to the police twice, she said. Once was after she was burglarized. The second was when she reported customers she suspected of making fraudulent documents.

The documents on the Moroccan businesses were compiled by a secretive team called the Demographics Unit, which police originally denied existed. After the AP obtained police documents describing the unit as a team of 16 officers with a mission to map and monitor ethnic neighborhoods, the department said the Demographics Unit used to exist but actually never had more than eight officers.

Browne, the department’s spokesman, has said the unit only followed leads. There is no indication in the documents, however, that police were only investigating criminal leads. Information about crimes was included in the Moroccan Initiative files, but these do not appear to be the program’s focus.

“The Demographics Team was instructed by me to re-canvas the city for any new locations and they came across a newly identified hotel that is referred to Moroccan tourists,” an unidentified supervisor wrote in an undated update on the initiative.

One police document, for example, lists taxi companies and Dunkin Donuts and Subway franchises known to hire Moroccans and other Arabs. A local gym and barber shop also are mentioned. The end of the document includes a section about criminal activity and identifies four businesses believed to be involved in marriage and document fraud and drug dealing.

Another document describes 14 restaurants, two travel agencies and a meat market catering to the Moroccan community. Another said the NYPD produced a list of every Moroccan cab driver in the city. Officers tried to interview them, but many were unavailable to be questioned because they were out working 12- to 14-hour shifts, the document said.

Current and former officials said the information collected by the Demographics Unit was kept on a computer inside the squad’s offices at the Brooklyn Army Terminal. It was not connected to the department’s central intelligence database, they said.

When a Moroccan was arrested, according to the documents, a unit called the Citywide Debriefing Team would visit him in jail or at his home. Each was asked how someone coming to the United States from Morocco might keep a low profile. Officers had a list of 13 questions, including where such a person might live, obtain identification cards, eat, worship and learn English.

The questions helped police identify small apartments in Brooklyn where Moroccan immigrants shared rooms soon after arriving in New York. Police visited one apartment in 2007 to meet with someone who had been arrested the prior year, according to the files. The officer noted the number of bedrooms, the layout, the furnishings and a wall calendar from a nearby mosque.

“There was a small table as well as an entertainment center,” the document said. “There were two Korans. One on top of each speaker.”

Police officials said such detailed note-taking was the result of enormous pressure inside the department. Officers assigned to conduct interviews and visit homes were told by supervisors that, if the subject of their interviews one day turned violent, their reports would be scrutinized with an eye for what warning signs were missed, officials said.

It was intended to keep officers sharp and remind them of the seriousness of the job, but officials said it encouraged well-meaning officers to record even innocent details.

Unlike the information from the Demographics Unit, the information from debriefings and personal visits was reported back to headquarters and entered into the police department’s central intelligence database, the Intelligence Data System, officials said.

Because of lawsuits by civil liberties groups, police lawyers have set stricter limits in recent years about information the NYPD compiles about people not accused of any crime, current and former officials said. Lawyers review police reports and sometimes require officers to remove information or rewrite their reports. Some information on innocent behavior is removed. Other information is labeled “sealed,” which means it can be seen only by very senior officials, the officials said.

Meanwhile, police received from the U.S. government regular updates on foreign visitors entering New York, according to documents and interviews. Police departments often receive information on visitors on a case-by-case basis. U.S. Customs and Border Protection, which maintains the federal documents, declined to tell the AP whether such broad access to its immigration files by a city police department was unusual.

Using the documents, known as I-94s, New York police located and interviewed Moroccans and, when possible, the families they were visiting. Often, that would take them to the homes of U.S. citizens.

Police couldn’t force people to talk to them or let them inside their homes, so officers often used a cover story about a crime in the neighborhood or a report of a missing child nearby, officials told the AP.

During such interviews, the officer would make note of the surroundings: What was on television? How many people lived there? What kind of furniture? If possible, police would collect from residents their names, phone numbers and occupations.

All this underscores the NYPD’s transformation from a police department solving murders and muggings to a domestic intelligence agency. It’s a transformation that Kelly, the police commissioner, makes no apologies for. He has credited intelligence efforts with thwarting terrorist attacks, and White House counterterrorism adviser John Brennan has called those efforts heroic.

No police department in the United States is known to employ programs like New York’s. Police in Los Angeles, the nation’s second-largest city, once considered a program that would have mapped the area’s Muslim communities, but it was shut down after news coverage sparked wide criticism.

Other police departments, including those in cities with Moroccan populations, operate differently — whether for philosophical reasons, because they lack the NYPD’s manpower or because their communities haven’t been targeted repeatedly by terrorists like New York.

In Revere, Mass., police did not dispatch officers into its Moroccan community after the overseas attacks. Revere, a city north of Boston, has a small Moroccan enclave of about 800 people, but it ranks among the top 10 largest Moroccan communities in the country, according to the Census Bureau.

“We wouldn’t just go and start interviewing people because of something that happened in another country,” police Capt. James Guido said. “The guys here wouldn’t even get involved in something like that.”

New York sees things differently, not just because its Moroccan community is a population of about 9,000 and by far the nation’s largest, but because Kelly has made it clear that the department will no longer wait for something to happen.

At the barber shop in Queens, Darhbach said he agrees police should keep the city safe but said that as an American citizen, his business shouldn’t be listed in police files just for serving Moroccan customers. But like many of his neighbors, who grew up under the oppressive police forces of the Middle East and North Africa, Darhbach said things could be worse.

“In Morocco,” he said, “police just come and take you away.”

The New York Police Department collected intelligence on more than 250 mosques and Muslim student groups in and around New York, often using undercover officers and informants to canvas the Islamic population of America’s largest city, according to officials and confidential, internal documents obtained by The Associated Press.

The documents, many marked “secret,” highlight how the past decade’s hunt for terrorists also put huge numbers of innocent people under scrutiny as they went about their daily lives in mosques, businesses and social groups.

An Associated Press investigation last month revealed that a secret squad known as the Demographics Unit sent teams of undercover officers to help key tabs on the area’s Muslim communities. The recent documents are the first to quantify that effort.

Since the 2001 attacks, the police department has built one of the nation’s most aggressive domestic intelligence agencies, one that operates far outside the city limits and maintains a list of “ancestries of interest” that it uses to focus its clandestine efforts. That effort has benefited from federal money and an unusually close relationship with the CIA, one that at times blurred the lines between domestic and foreign intelligence-gathering.

After identifying more than 250 area mosques, police officials determined the “ethnic orientation, leadership and group affiliations,” according to the 2006 police documents. Police also used informants and teams of plainclothes officers, known as rakers, to identify mosques requiring further scrutiny, according to an official involved in that effort, who spoke on condition of anonymity because he was not authorized to discuss the program.

Armed with that information, police then identified 53 “mosques of concern” and placed undercover officers and informants there, the documents show.

Many of those mosques were flagged for allegations of criminal activity, such as alien smuggling, financing Hamas or money laundering. Others were identified for having ties to Salafism, a hardline movement preaching a strict version of Islamic law. Still others were identified for what the documents refer to as “rhetoric.”

Other reasons are less clear.

Two mosques, for instance, were flagged for having ties to Al-Azhar, the 1,000-year-old Egyptian mosque that is the pre-eminent institute of Islamic learning in the Sunni Muslim world. Al-Azhar was one of the first religious institutions to condemn the 2001 terrorist attacks. President George W. Bush’s close adviser, Karen Hughes, visited Al-Azhar in 2005 and applauded its courage.

Al-Azhar was also a sponsor of President Barack Obama’s 2009 speech reaching out to the Muslim world.

The list of mosques where undercover agents or informants operated includes ones that Police Commissioner Ray Kelly has visited and that area officials have mentioned as part of the region’s strong ties to the Muslim community. Mayor Michael Bloomberg has stood beside leaders of some mosques on the list as allies in fighting terrorism.

The documents are a series of internal presentations, including one prepared for Kelly. Following the AP’s reporting, they were provided to the AP and veteran New York police reporter Leonard Levitt, who runs the website NYPDConfidential.com. Because the list of mosques is so long and explanation for the surveillance is so limited, the AP is not identifying the individual mosques that were under surveillance.

An NYPD spokesman and spokeswoman did not immediately return messages seeking comment Monday, a holiday. The police department has said it follows leads and does not trawl entire neighborhoods.

New York Police identified 263 “hot spots” throughout the city, the documents show. Like the mosques, the examples of hot spots ranged from businesses that sold untaxed cigarettes and where inflammatory rhetoric was overheard to those with less obvious criminal connections.

At one Bangladeshi restaurant, for instance, police identified a “devout crowd” from a nearby mosque — which was not among the listed mosques of concern. The restaurant’s list of “alleged activities” also included being a “popular meeting location for political activities.”

It is another example undercutting Bloomberg’s claim that the NYPD does not take religion into account in its policing. Last week the AP revealed that the NYPD maintained a list of “ancestries of interest” that included “American Black Muslim,” which is a religion, not an ancestry.

Police also kept tabs on seven of the area’s Muslim student associations, defined in the documents as “a university-based student group, with an Islamic focus, involved with religious and political activities.” Two were flagged for having Salafi speakers. One was cited for having students who are “politically active and are radicalizing.”

The documents appear at times at odds with the White House’s newly released policy on combatting violent extremism. That document discourages authorities from casting suspicion on communities or conflating strong religious views with violent extremism. The White House has declined to comment on the NYPD’s clandestine programs but has applauded its counterterrorism efforts.

Since the AP reports, several Muslim civil rights groups and a New York congresswoman have urged the Justice Department to investigate the NYPD for what critics see as racial profiling. Under Attorney General Eric Holder, the Justice Department has stepped up investigations of local police departments for possible civil rights violations, but none involves national security cases.

In New Brunswick, N.J., a building superintendent opened the door to apartment No. 1076 one balmy Tuesday and discovered an alarming scene: terrorist literature strewn about the table and computer and surveillance equipment set up in the next room.

The panicked superintendent dialed 911, sending police and the FBI rushing to the building near Rutgers University on the afternoon of June 2, 2009. What they found in that first-floor apartment, however, was not a terrorist hideout but a command center set up by a secret team of New York Police Department intelligence officers.

From that apartment, about an hour outside the department’s jurisdiction, the NYPD had been staging undercover operations and conducting surveillance throughout New Jersey. Neither the FBI nor the local police had any idea.

Since the terrorist attacks of Sept. 11, 2001, the NYPD has become one of the country’s most aggressive domestic intelligence agencies. A months-long investigation by The Associated Press has revealed that the NYPD operates far outside its borders and targets ethnic communities in ways that would run afoul of civil liberties rules if practiced by the federal government. And it does so with unprecedented help from the CIA in a partnership that has blurred the bright line between foreign and domestic spying.

Neither the city council, which finances the department, nor the federal government, which contributes hundreds of millions of dollars each year, is told exactly what’s going on.

The department has dispatched teams of undercover officers, known as “rakers,” into minority neighborhoods as part of a human mapping program, according to officials directly involved in the program. They’ve monitored daily life in bookstores, bars, cafes and nightclubs. Police have also used informants, known as “mosque crawlers,” to monitor sermons, even when there’s no evidence of wrongdoing. NYPD officials have scrutinized imams and gathered intelligence on cab drivers and food cart vendors, jobs often done by Muslims.

Many of these operations were built with help from the CIA, which is prohibited from spying on Americans but was instrumental in transforming the NYPD’s intelligence unit.

A veteran CIA officer, while still on the agency’s payroll, was the architect of the NYPD’s intelligence programs. The CIA trained a police detective at the Farm, the agency’s spy school in Virginia, then returned him to New York, where he put his new espionage skills to work inside the United States.

And just last month, the CIA sent a senior officer to work as a clandestine operative inside police headquarters.

While the expansion of the NYPD’s intelligence unit has been well known, many details about its clandestine operations, including the depth of its CIA ties, have not previously been reported.

The NYPD denied that it trolls ethnic neighborhoods and said it only follows leads. In a city that has repeatedly been targeted by terrorists, police make no apologies for pushing the envelope. NYPD intelligence operations have disrupted terrorist plots and put several would-be killers in prison.

“The New York Police Department is doing everything it can to make sure there’s not another 9/11 here and that more innocent New Yorkers are not killed by terrorists,” NYPD spokesman Paul Browne said. “And we have nothing to apologize for in that regard.”

But officials said they’ve also been careful to keep information about some programs out of court, where a judge might take a different view. The NYPD considers even basic details, such as the intelligence division’s organization chart, to be too sensitive to reveal in court.

One of the enduring questions of the past decade is whether being safe requires giving up some liberty and privacy. The focus of that debate has primarily been federal programs like wiretapping and indefinite detention. The question has received less attention in New York, where residents do not know for sure what, if anything, they have given up.

The story of how the NYPD Intelligence Division developed such aggressive programs was pieced together by the AP in interviews with more than 40 current and former New York Police Department and federal officials. Many were directly involved in planning and carrying out these secret operations for the department. Though most said the tactics were appropriate and made the city safer, many insisted on anonymity, because they were not authorized to speak with reporters about security matters.

The story begins with one man.

David Cohen arrived at the New York Police Department in January 2002, just weeks after the last fires had been extinguished at the debris field that had been the twin towers. A retired 35-year veteran of the CIA, Cohen became the police department’s first civilian intelligence chief.

Cohen had an exceptional career at the CIA, rising to lead both the agency’s analytical and operational divisions. He also was an extraordinarily divisive figure, a man whose sharp tongue and supreme confidence in his own abilities gave him a reputation as arrogant. Cohen’s tenure as head of CIA operations, the nation’s top spy, was so contentious that in 1997, The New York Times editorial page took the unusual step of calling for his ouster.

He had no police experience. He had never defended a city from an attack. But New York wasn’t looking for a cop.

“Post-9/11, we needed someone in there who knew how to really gather intelligence,” said John Cutter, a retired NYPD official who served as one of Cohen’s top uniformed officers.

At the time, the intelligence division was best known for driving dignitaries around the city. Cohen envisioned a unit that would analyze intelligence, run undercover operations and cultivate a network of informants. In short, he wanted New York to have its own version of the CIA.

Cohen shared Commissioner Ray Kelly’s belief that 9/11 had proved that the police department could not simply rely on the federal government to prevent terrorism in New York.

“If anything goes on in New York,” one former officer recalls Cohen telling his staff in the early days, “it’s your fault.”

Among Cohen’s earliest moves at the NYPD was making a request of his old colleagues at CIA headquarters in Langley, Va. He needed someone to help build this new operation, someone with experience and clout and, most important, someone who had access to the latest intelligence so the NYPD wouldn’t have to rely on the FBI to dole out information.

CIA Director George Tenet responded by tapping Larry Sanchez, a respected veteran who had served as a CIA official inside the United Nations. Often, when the CIA places someone on temporary assignment, the other agency picks up the tab. In this case, three former intelligence officials said, Tenet kept Sanchez on the CIA payroll.

When he arrived in New York in March 2002, Sanchez had offices at both the NYPD and the CIA’s station in New York, one former official said. Sanchez interviewed police officers for newly defined intelligence jobs. He guided and mentored officers, schooling them in the art of gathering information. He also directed their efforts, another said.

There had never been an arrangement like it, and some senior CIA officials soon began questioning whether Tenet was allowing Sanchez to operate on both sides of the wall that’s supposed to keep the CIA out of the domestic intelligence business.

“It should not be a surprise to anyone that, after 9/11, the Central Intelligence Agency stepped up its cooperation with law enforcement on counterterrorism issues or that some of that increased cooperation was in New York, the site of ground zero,” CIA spokeswoman Jennifer Youngblood said.

Just as at the CIA, Cohen and Sanchez knew that informants would have to become the backbone of their operation. But with threats coming in from around the globe, they couldn’t wait months for the perfect plan.

They came up with a makeshift solution. They dispatched more officers to Pakistani neighborhoods and, according to one former police official directly involved in the effort, instructed them to look for reasons to stop cars: speeding, broken tail lights, running stop signs, whatever. The traffic stop gave police an opportunity to search for outstanding warrants or look for suspicious behavior. An arrest could be the leverage the police needed to persuade someone to become an informant.

For Cohen, the transition from spying to policing didn’t come naturally, former colleagues said. When faced with a decision, especially early in his tenure, he’d fall back on his CIA background. Cutter said he and other uniformed officers had to tell Cohen, no, we can’t just slip into someone’s apartment without a warrant. No, we can’t just conduct a search. The rules for policing are different.

While Cohen was being shaped by the police department, his CIA background was remaking the department. But one significant barrier stood in the way of Cohen’s vision.

Since 1985, the NYPD had operated under a federal court order limiting the tactics it could use to gather intelligence. During the 1960s and 1970s, the department had used informants and undercover officers to infiltrate anti-war protest groups and other activists without any reason to suspect criminal behavior.

To settle a lawsuit, the department agreed to follow guidelines that required “specific information” of criminal activity before police could monitor political activity.

In September 2002, Cohen told a federal judge that those guidelines made it “virtually impossible” to detect terrorist plots. The FBI was changing its rules to respond to 9/11, and Cohen argued that the NYPD must do so, too.

“In the case of terrorism, to wait for an indication of crime before investigating is to wait far too long,” Cohen wrote.

U.S. District Judge Charles S. Haight Jr. agreed, saying the old guidelines “addressed different perils in a different time.” He scrapped the old rules and replaced them with more lenient ones.

It was a turning point for the NYPD.

With his newfound authority, Cohen created a secret squad that would soon infiltrate Muslim neighborhoods, according to several current and former officials directly involved in the program.

The NYPD carved up the city into more than a dozen zones and assigned undercover officers to monitor them, looking for potential trouble.

At the CIA, one of the biggest obstacles has always been that U.S. intelligence officials are overwhelmingly white, their mannerisms clearly American. The NYPD didn’t have that problem, thanks to its diverse pool of officers.

Using census data, the department matched undercover officers to ethnic communities and instructed them to blend in, the officials said. Pakistani-American officers infiltrated Pakistani neighborhoods, Palestinians focused on Palestinian neighborhoods. They hung out in hookah bars and cafes, quietly observing the community around them.

The unit, which has been undisclosed now, became known inside the department as the Demographic Unit, former police officials said.

“It’s not a question of profiling. It’s a question of going where the problem could arise,” said Mordecai Dzikansky, a retired NYPD intelligence officer who said he was aware of the Demographic Unit. “And thank God we have the capability. We have the language capability and the ethnic officers. That’s our hidden weapon.”

The officers did not work out of headquarters, officials said. Instead, they passed their intelligence to police handlers who knew their identities.

Cohen said he wanted the squad to “rake the coals, looking for hot spots,” former officials recalled. The undercover officers soon became known inside the department as rakers.

A hot spot might be a beauty supply store selling chemicals used for making bombs. Or it might be a hawala, a broker that transfers money around the world with little documentation. Undercover officers might visit an Internet cafe and look at the browsing history on a computer, a former police official involved in the program said. If it revealed visits to radical websites, the cafe might be deemed a hot spot.

Ethnic bookstores, too, were on the list. If a raker noticed a customer looking at radical literature, he might chat up the store owner and see what he could learn. The bookstore, or even the customer, might get further scrutiny. If a restaurant patron applauds a news report about the death of U.S. troops, the patron or the restaurant could be labeled a hot spot.

The goal was to “map the city’s human terrain,” one law enforcement official said. The program was modeled in part on how Israeli authorities operate in the West Bank, a former police official said.

Mapping crimes has been a successful police strategy nationwide. But mapping robberies and shootings is one thing. Mapping ethnic neighborhoods is different, something that at least brushes against what the federal government considers racial profiling.

Browne, the NYPD spokesman, said the Demographic Unit does not exist. He said the department has a Zone Assessment Unit that looks for locations that could attract terrorists. But he said undercover officers only followed leads, disputing the account of several current and former police and federal officials. They do not just hang out in neighborhoods, he said.

“We will go into a location, whether it’s a mosque or a bookstore, if the lead warrants it, and at least establish whether there’s something that requires more attention,” Browne said.

That conflicts with testimony from an undercover officer in the 2006 trial of Shahawar Matin Siraj, who was convicted of planning an attack on New York’s subway system. The officer said he was instructed to live in Brooklyn and act as a “walking camera” for police.

“I was told to act like a civilian — hang out in the neighborhood, gather information,” the Bangladeshi officer testified, under a false name, in what offered the first narrow glimpse at the NYPD’s infiltration of ethnic neighborhoods.

Officials said such operations just made sense. Islamic terrorists had attacked the city on 9/11, so police needed people inside the city’s Muslim neighborhoods. Officials say it does not conflict with a 2004 city law prohibiting the NYPD from using religion or ethnicity “as the determinative factor for initiating law enforcement action.”

“It’s not profiling,” Cutter said. “It’s like, after a shooting, do you go 20 blocks away and interview guys or do you go to the neighborhood where it happened?”

In 2007, the Los Angeles Police Department was criticized for even considering a similar program. The police announced plans to map Islamic neighborhoods to look for pockets of radicalization among the region’s roughly 500,000 Muslims. Criticism was swift, and chief William Bratton scrapped the plan.

“A lot of these people came from countries where the police were the terrorists,” Bratton said at a news conference, according to the Los Angeles Daily News. “We don’t do that here. We do not want to spread fear.”

In New York, current and former officials said, the lesson of that controversy was that such programs should be kept secret.

Some in the department, including lawyers, have privately expressed concerns about the raking program and how police use the information, current and former officials said. Part of the concern was that it might appear that police were building dossiers on innocent people, officials said. Another concern was that, if a case went to court, the department could be forced to reveal details about the program, putting the entire operation in jeopardy.

That’s why, former officials said, police regularly shredded documents discussing rakers.

When Cohen made his case in court that he needed broader authority to investigate terrorism, he had promised to abide by the FBI’s investigative guidelines. But the FBI is prohibited from using undercover agents unless there’s specific evidence of criminal activity, meaning a federal raking program like the one officials described to the AP would violate FBI guidelines.

The NYPD declined to make Cohen available for comment. In an earlier interview with the AP on a variety of topics, Police Commissioner Kelly said the intelligence unit does not infringe on civil rights.

“We’re doing what we believe we have to do to protect the city,” he said. “We have many, many lawyers in our employ. We see ourselves as very conscious and aware of civil liberties. And we know there’s always going to be some tension between the police department and so-called civil liberties groups because of the nature of what we do.”

The department clashed with civil rights groups most publicly after Cohen’s undercover officers infiltrated anti-war groups before the 2004 Republican National Convention in New York. A lawsuit over that program continues today.

During the convention, when protesters were arrested, police asked a list of questions which, according to court documents, included: “What are your political affiliations?” “Do you do any kind of political work?” and “Do you hate George W. Bush?”

“At the end of the day, it’s pure and simple a rogue domestic surveillance operation,” said Christopher Dunn, a New York Civil Liberties Union lawyer involved in the convention lawsuit.

Undercover agents like the rakers were valuable, but what Cohen and Sanchez wanted most were informants.

The NYPD dedicated an entire squad, the Terrorist Interdiction Unit, to developing and handling informants. Current and former officials said Sanchez was instrumental in teaching them how to develop sources.

For years, detectives used informants known as mosque crawlers to monitor weekly sermons and report what was said, several current and former officials directly involved in the informant program said. If FBI agents were to do that, they would be in violation of the Privacy Act, which prohibits the federal government from collecting intelligence on purely First Amendment activities.

The FBI has generated its own share of controversy for putting informants inside mosques, but unlike the program described to the AP, the FBI requires evidence of a crime before an informant can be used inside a mosque.

Valerie Caproni, the FBI’s general counsel, would not discuss the NYPD’s programs but said FBI informants can’t troll mosques looking for leads. Such operations are reviewed for civil liberties concerns, she said.

“If you’re sending an informant into a mosque when there is no evidence of wrongdoing, that’s a very high-risk thing to do,” Caproni said. “You’re running right up against core constitutional rights. You’re talking about freedom of religion.”

That’s why senior FBI officials in New York ordered their own agents not to accept any reports from the NYPD’s mosque crawlers, two retired agents said.

It’s unclear whether the police department still uses mosque crawlers. Officials said that, as Muslims figured out what was going on, the mosque crawlers became cafe crawlers, fanning out into the city’s ethnic hangouts.

“Someone has a great imagination,” Browne, the NYPD spokesman, said. “There is no such thing as mosque crawlers.”

Following the foiled subway plot, however, the key informant in the case, Osama Eldawoody, said he attended hundreds of prayer services and collected information even on people who showed no signs of radicalization.

NYPD detectives have recruited shopkeepers and nosy neighbors to become “seeded” informants who keep police up to date on the latest happenings in ethnic neighborhoods, one official directly involved in the informant program said.

The department also has a roster of “directed” informants it can tap for assignments. For instance, if a raker identifies a bookstore as a hot spot, police might assign an informant to gather information, long before there’s concrete evidence of anything criminal.

To identify possible informants, the department created what became known as the “debriefing program.” When someone is arrested who might be useful to the intelligence unit — whether because he said something suspicious or because he is simply a young Middle Eastern man — he is singled out for extra questioning. Intelligence officials don’t care about the underlying charges; they want to know more about his community and, ideally, they want to put him to work.

Police are in prisons, too, promising better living conditions and help or money on the outside for Muslim prisoners who will work with them.

Early in the intelligence division’s transformation, police asked the taxi commission to run a report on all the city’s Pakistani cab drivers, looking for those who got licenses fraudulently and might be susceptible to pressure to cooperate, according to former officials who were involved in or briefed on the effort.

That strategy has been rejected in other cities.

Boston police once asked neighboring Cambridge for a list of Somali cab drivers, Cambridge Police Chief Robert Haas said. Haas refused, saying that without a specific reason, the search was inappropriate.

“It really has a chilling effect in terms of the relationship between the local police department and those cultural groups, if they think that’s going to take place,” Haas said.

The informant division was so important to the NYPD that Cohen persuaded his former colleagues to train a detective, Steve Pinkall, at the CIA’s training center at the Farm. Pinkall, who had an intelligence background as a Marine, was given an unusual temporary assignment at CIA headquarters, officials said. He took the field tradecraft course alongside future CIA spies then returned to New York to run investigations.

“We found that helpful, for NYPD personnel to be exposed to the tradecraft,” Browne said.

The idea troubled senior FBI officials, who saw it as the NYPD and CIA blurring the lines between police work and spying, in which undercover officers regularly break the laws of foreign governments. The arrangement even made its way to FBI Director Robert Mueller, two former senior FBI officials said, but the training was already under way and Mueller did not press the issue.

NYPD’s intelligence operations do not stop at the city line, as the undercover operation in New Jersey made clear.

The department has gotten some of its officers deputized as federal marshals, allowing them to work out of state. But often, there’s no specific jurisdiction at all. Cohen’s undercover squad, the Special Services Unit, operates in places such as New Jersey, Pennsylvania and Massachusetts, officials said. They can’t make arrests and, if something goes wrong — a shooting or a car accident, for instance — the officers could be personally liable. But the NYPD has decided it’s worth the risk, a former police official said.

With Police Commissioner Kelly’s backing, Cohen’s policy is that any potential threat to New York City is the NYPD’s business, regardless of where it occurs, officials said.

That aggressiveness has sometimes put the NYPD at odds with local police departments and, more frequently, with the FBI. The FBI didn’t like the rules Cohen played by and said his operations encroached on their responsibilities.

Once, undercover officers were stopped by police in Massachusetts while conducting surveillance on a house, one former New York official recalled. In another instance, the NYPD sparked concern among federal officials by expanding its intelligence-gathering efforts related to the United Nations, where the FBI is in charge, current and former federal officials said.

The AP has agreed not to disclose details of either the FBI or NYPD operations because they involve foreign counterintelligence.

Both Mueller and Kelly have said their agencies have strong working relationships and said reports of rivalry and disagreements are overblown. And the NYPD’s out-of-state operations have had success.

A young Egyptian NYPD officer living undercover in New Jersey, for example, was key to building a case against Mohamed Mahmood Alessa and Carlos Eduardo Almonte. The pair was arrested last year at John F. Kennedy Airport en route to Somalia to join the terrorist group al-Shabab. Both pleaded guilty to conspiracy.

Cohen has also sent officers abroad, stationing them in 11 foreign cities. If a bomber blows himself up in Jerusalem, the NYPD rushes to the scene, said Dzikansky, who served in Israel and is the co-author of the forthcoming book “Terrorist Suicide Bombings: Attack Interdiction, Mitigation, and Response.”

“I was there to ask the New York question,” Dzikansky said. “Why this location? Was there something unique that the bomber had done? Was there any pre-notification. Was there a security lapse?”

All of this intelligence — from the rakers, the undercovers, the overseas liaisons and the informants — is passed to a team of analysts hired from some of the nation’s most prestigious universities. Analysts have spotted emerging trends and summarized topics such as Hezbollah’s activities in New York and the threat of South Asian terrorist groups.

They also have tackled more contentious topics, including drafting an analytical report on every mosque within 100 miles of New York, one former police official said. The report drew on information from mosque crawlers, undercover officers and public information. It mapped hundreds of mosques and discussed the likelihood of them being infiltrated by al-Qaida, Hezbollah and other terrorist groups.

For Cohen, there was only one way to measure success: “They haven’t attacked us,” he said in a 2005 deposition. He said anything that was bad for terrorists was good for NYPD.

Though the CIA is prohibited from collecting intelligence domestically, the wall between domestic and foreign operations became more porous. Intelligence gathered by the NYPD, with CIA officer Sanchez overseeing collection, was often passed to the CIA in informal conversations and through unofficial channels, a former official involved in that process said.

By design, the NYPD was looking more and more like a domestic CIA.

“It’s like starting the CIA over in the post-9/11 world,” Cohen said in “Protecting the City,” a laudatory 2009 book about the NYPD. “What would you do if you could begin it all over again? Hah. This is what you would do.”

Sanchez’s assignment in New York ended in 2004, but he received permission to take a leave of absence from the agency and become Cohen’s deputy, former officials said.

Though Sanchez’s assignments were blessed by CIA management, some in the agency’s New York station saw the presence of such a senior officer in the city as a turf encroachment. Finally, the New York station chief, Tom Higgins, called headquarters, one former senior intelligence official said. Higgins complained, the official said, that Sanchez was wearing both hats, sometimes acting as a CIA officer, sometimes as an NYPD official.

The CIA finally forced him to choose: Stay with the agency or stay with the NYPD.

Sanchez declined to comment to the AP about the arrangement, but he picked the NYPD. He retired last year and is now a consultant in the Middle East.

Last month, the CIA deepened its NYPD ties even further. It sent one of its most experienced operatives, a former station chief in two Middle Eastern countries, to work out of police headquarters as Cohen’s special assistant while on the CIA payroll. Current and former U.S. officials acknowledge it’s unusual but said it’s the kind of collaboration Americans expect after 9/11.

Officials said revealing the CIA officer’s name would jeopardize national security. The arrangement was described as a sabbatical. He is a member of the agency’s senior management, but officials said he was sent to the municipal police department to get management experience.

At the NYPD, he works undercover in the senior ranks of the intelligence division. Officials are adamant that he is not involved in actual intelligence-gathering.

The NYPD has faced little scrutiny over the past decade as it has taken on broad new intelligence missions, targeted ethnic neighborhoods and partnered with the CIA in extraordinary ways.

The department’s primary watchdog, the New York City Council, has not held hearings on the intelligence division’s operations and former NYPD officials said council members typically do not ask for details.

“Ray Kelly briefs me privately on certain subjects that should not be discussed in public,” said City Councilman Peter Vallone. “We’ve discussed in person how they investigate certain groups they suspect have terrorist sympathizers or have terrorist suspects.”

The city comptroller’s office has audited several NYPD components since 9/11 but not the intelligence unit, which had a $62 million budget last year.

The federal government, too, has done little to scrutinize the nation’s largest police force, despite the massive federal aid. Homeland Security officials review NYPD grants but not its underlying programs.

A report in January by the Homeland Security inspector general, for instance, found that the NYPD violated state and federal contracting rules between 2006 and 2008 by buying more than $4 million in equipment through a no-bid process. NYPD said public bidding would have revealed sensitive information to terrorists, but police never got approval from state or federal officials to adopt their own rules, the inspector general said.

On Capitol Hill, where FBI tactics have frequently been criticized for their effect on civil liberties, the NYPD faces no such opposition.

In 2007, Sanchez testified before the Senate Homeland Security Committee and was asked how the NYPD spots signs of radicalization. He said the key was viewing innocuous activity, including behavior that might be protected by the First Amendment, as a potential precursor to terrorism.

That triggered no questions from the committee, which Sanchez said had been “briefed in the past on how we do business.”

The Justice Department has the authority to investigate civil rights violations. It issued detailed rules in 2003 against racial profiling, including prohibiting agencies from considering race when making traffic stops or assigning patrols.

But those rules apply only to the federal government and contain a murky exemption for terrorism investigations. The Justice Department has not investigated a police department for civil rights violations during a national security investigation.

“One of the hallmarks of the intelligence division over the last 10 years is that, not only has it gotten extremely aggressive and sophisticated, but it’s operating completely on its own,” said Dunn, the civil liberties lawyer. “There are no checks. There is no oversight.”

The NYPD has been mentioned as a model for policing in the post-9/11 era. But it’s a model that seems custom-made for New York. No other city has the Big Apple’s combination of a low crime rate, a $4.5 billion police budget and a diverse 34,000-person police force. Certainly no other police department has such deep CIA ties.

Perhaps most important, nobody else had 9/11 the way New York did. No other city lost nearly 3,000 people in a single morning. A decade later, police say New Yorkers still expect the department to do whatever it can to prevent another attack. The NYPD has embraced that expectation.

As Sanchez testified on Capitol Hill: “We’ve been given the public tolerance and the luxury to be very aggressive on this topic.”

Meet the CIA analyst who tracked down the al-Qaida leader over the course of a decade

After Navy SEALs killed Osama bin Laden, the White House released a photo of President Barack Obama and his Cabinet inside the Situation Room, watching the daring raid unfold.

Hidden from view, standing just outside the frame of that now-famous photograph was a career CIA analyst. In the hunt for the world’s most-wanted terrorist, there may have been no one more important. His job for nearly a decade was finding the al-Qaida leader.

The analyst was the first to put in writing last summer that the CIA might have a legitimate lead on finding bin Laden. He oversaw the collection of clues that led the agency to a fortified compound in Abbottabad, Pakistan. His was among the most confident voices telling Obama that bin Laden was probably behind those walls.

The CIA will not permit him to speak with reporters. But interviews with former and current U.S. intelligence officials reveal a story of quiet persistence and continuity that led to the greatest counterterrorism success in the history of the CIA. Nearly all the officials insisted on anonymity because they were not authorized to speak to reporters or because they did not want their names linked to the bin Laden operation.

The Associated Press has agreed to the CIA’s request not to publish his full name and withhold certain biographical details so that he would not become a target for retribution.

Call him John, his middle name.

John was among the hundreds of people who poured into the CIA’s Counterterrorism Center after the Sept. 11 attacks, bringing fresh eyes and energy to the fight.

He had been a standout in the agency’s Russian and Balkan departments. When Vladimir Putin was coming to power in Russia, for instance, John pulled together details overlooked by others and wrote what some colleagues considered the definitive profile of Putin. He challenged some of the agency’s conventional wisdom about Putin’s KGB background and painted a much fuller portrait of the man who would come to dominate Russian politics.

That ability to spot the importance of seemingly insignificant details, to weave disparate strands of information into a meaningful story, gave him a particular knack for hunting terrorists.

“He could always give you the broader implications of all these details we were amassing,” said John McLaughlin, who as CIA deputy director was briefed regularly by John in the mornings after the 2001 attacks.

From 2003, when he joined the counterterrorism center, through 2005, John was one of the driving forces behind the most successful string of counterterrorism captures in the fight against terrorism: Abu Zubaydah, Abd al-Nashiri, Khalid Sheik Mohammed, Ramzi bin Alshib, Hambali and Faraj al-Libi.

But there was no greater prize than finding bin Laden.

Bin Laden had slipped away from U.S. forces in the Afghan mountains of Tora Bora in 2001, and the CIA believed he had taken shelter in the lawless tribal areas of Pakistan. In 2006, the agency mounted Operation Cannonball, an effort to establish bases in the tribal regions and find bin Laden. Even with all its money and resources, the CIA could not locate its prime target.

By then, the agency was on its third director since Sept. 11, 2001. John had outlasted many of his direct supervisors who retired or went on to other jobs. The CIA doesn’t like to keep its people in one spot for too long. They become jaded. They start missing things.

John didn’t want to leave. He’d always been persistent. In college, he walked on to a Division I basketball team and hustled his way into a rotation full of scholarship players.

The CIA offered to promote him and move him somewhere else. John wanted to keep the bin Laden file.

He examined and re-examined every aspect of bin Laden’s life. How did he live while hiding in Sudan? With whom did he surround himself while living in Kandahar, Afghanistan? What would a bin Laden hideout look like today?

The CIA had a list of potential leads, associates and family members who might have access to bin Laden.

“Just keep working that list bit by bit,” one senior intelligence official recalls John telling his team. “He’s there somewhere. We’ll get there.”

John rose through the ranks of the counterterrorism center, but because of his nearly unrivaled experience, he always had influence beyond his title. One former boss confessed that he didn’t know exactly what John’s position was.

“I knew he was the guy in the room I always listened to,” the official said.

While he was shepherding the hunt for bin Laden, John also was pushing to expand the Predator program, the agency’s use of unmanned airplanes to launch missiles at terrorists. The CIA largely confined those strikes to targets along Pakistan’s border with Afghanistan. But in late 2007 and early 2008, John said the CIA needed to carry out those attacks deeper inside Pakistan.

It was a risky move. Pakistan was an important but shaky ally. John’s analysts saw an increase in the number of Westerners training in Pakistani terrorist camps. John worried that those men would soon start showing up on U.S. soil.

“We’ve got to act,” John said, a former senior intelligence official recalls. “There’s no explaining inaction.”

John took the analysis to then CIA Director Michael Hayden, who agreed and took the recommendation to President George W. Bush. In the last months of the Bush administration, the CIA began striking deeper inside Pakistan. Obama immediately adopted the same strategy and stepped up the pace. Recent attacks have killed al-Qaida’s No. 3 official, Mustafa Abu al-Yazid, and Pakistani Taliban leader Baitullah Mehsud.

All the while, John’s team was working the list of bin Laden leads. In 2007, a female colleague whom the AP has also agreed not to identify decided to zero in on a man known as Abu Ahmed al-Kuwaiti, a nom de guerre. Other terrorists had identified al-Kuwaiti as an important courier for al-Qaida’s upper echelon, and she believed that finding him might help lead to bin Laden.

“They had their teeth clenched on this and they weren’t going to let go,” McLaughlin said of John and his team. “This was an obsession.”

It took three years, but in August 2010, al-Kuwaiti turned up on a National Security Agency wiretap. The female analyst, who had studied journalism at a Big Ten university, tapped out a memo for John, “Closing in on Bin Laden Courier,” saying her team believed al-Kuwaiti was somewhere on the outskirts of Islamabad.

As the CIA homed in on al-Kuwaiti, John’s team continually updated the memo with fresh information. Everyone knew that anything with bin Laden’s name on it would shoot right to the director’s desk and invite scrutiny, so the early drafts played down hopes that the courier would lead to bin Laden. But John saw the bigger picture. The hunt for al-Kuwaiti was effectively the hunt for bin Laden, and he was not afraid to say so.

The revised memo was finished in September 2010. John, by then deputy chief of the Pakistan-Afghanistan Department, emailed it to those who needed to know. The title was “Anatomy of a Lead.”

As expected, the memo immediately became a hot topic inside CIA headquarters and Director Leon Panetta wanted to know more. John never overpromised, colleagues recall, but he was unafraid to say there was a good chance this might be the break the agency was looking for.

The CIA tracked al-Kuwaiti to a walled compound in Abbottabad. If bin Laden was hiding there, in a busy suburb not far from Pakistan’s military academy, it challenged much of what the agency had assumed about his hideout.

But John said it wasn’t that far-fetched. Drawing on what he knew about bin Laden’s earlier hideouts, he said it made sense that bin Laden had surrounded himself only with his couriers and family and did not use phones or the Internet. The CIA knew that top al-Qaida operatives had lived in urban areas before.

A cautious Panetta took the information to Obama, but there was much more work to be done.

The government tried everything to figure out who was in that compound.

In a small house nearby, the CIA put people who would fit in and not draw any attention. They watched and waited but turned up nothing definitive. Satellites captured images of a tall man walking the grounds of the compound, but never got a look at his face.

Again and again, John and his team asked themselves who else might be living in that compound. They came up with five or six alternatives; bin Laden was always the best explanation.

This went on for months. By about February, John told his bosses, including Panetta, that the CIA could keep trying, but the information was unlikely to get any better. He told Panetta this might be their best chance to find bin Laden and it would not last forever. Panetta made that same point to the president

Panetta held regular meetings on the hunt, often concluding with an around-the-table poll: How sure are you that this is bin Laden?

John was always bullish, rating his confidence as high as 80 percent.

Others weren’t so sure, especially those who had been in the room for operations that went bad. Not two years earlier, the CIA thought it had an informant who could lead him to bin Laden’s deputy. That man blew himself up at a base in Khost, Afghanistan, killing seven CIA employees and injuring six others.

That didn’t come up in the meetings with Panetta, a senior intelligence official said. But everyone knew the risk the CIA was taking if it told the president that bin Laden was in Abbottabad and was wrong.

“We all knew that if he wasn’t there and this was a disaster, certainly there would be consequences,” the official recalled.

John was among several CIA officials who repeatedly briefed Obama and others at the White House. Current and former officials involved in the discussions said John had a coolness and a reassuring confidence.

By April, the president had decided to send the Navy SEALs to assault the compound.

Though the plan was in motion, John went back to his team, a senior intelligence official said.

“Right up to the last hour,” he told them, “if we get any piece of information that suggests it’s not him, somebody has to raise their hand before we risk American lives.”

Nobody did. Inside the Situation Room, the analyst who was barely known outside the close-knit intelligence world took his place alongside the nation’s top security officials, the household names and well-known faces of Washington.

An agonizing 40 minutes after Navy SEALs stormed the compound, the report came back: Bin Laden was dead.

John and his team had guessed correctly, taking an intellectual risk based on incomplete information. It was a gamble that ended a decade of disappointment. Later, Champagne was uncorked back at the CIA, where those in the Counterterrorism Center who had targeted bin Laden for so long celebrated. John’s team reveled in the moment.

Two days after bin Laden’s death, John accompanied Panetta to Capitol Hill. The Senate Intelligence Committee wanted a full briefing on the successful mission. At one point in the private session, Panetta turned to the man whose counterterrorism resume spanned four CIA directors.

He began to speak, about the operation and about the years of intelligence it was based on. And as he spoke about the mission that had become his career, the calm, collected analyst paused, and he choked up.
