June 1, 2007 | Editor's note: In March, I. Lewis "Scooter" Libby was convicted of perjury, obstruction of justice and false statements made to federal investigators arising out of an investigation into the leaking of the name of former covert CIA operative Valerie Plame. A sentencing hearing has been set for June 5, 2007. On Thursday, the defense team for Libby released a sentencing memorandum calling for Libby to be sentenced to probation, as well as a response to special counsel Patrick Fitzgerald's own sentencing memorandum, which calls for Libby to serve 30 to 37 months in prison. Below are screen shots of the first two pages of the defense's memorandum, in which the defense describes Libby's positive attributes and explains what it believes to be the relevant sentencing standard. On the next page is a screen shot of the portion of the memo in which the defense summarizes its argument as to why Libby deserves to be sentenced not to prison but to probation. The last page contains a screen shot of the page of the memo in which Libby's lawyers give their final recommendation for their client's sentence. The Libby defense team's full sentencing memorandum is available for download here , and its full response to the prosecution's memorandum is available here.
