VISTA, Calif. (AP) — A jury deliberated about an hour before convicting a man of attempted murder for repeatedly firing his gun at a San Diego-area elementary school.
Brendan O'Rourke was convicted Monday in the October 2010 attack at Kelly Elementary School in Carlsbad. Two second-grade girls were wounded in the attack.
U-T San Diego (http://bit.ly/z480yZ) reports that a prosecutor told jurors O'Rourke fired six times on a playground with 230 children as potential targets. A defense attorney questioned if O'Rourke intended to kill.
The same jury in Vista now must decide if O'Rourke was sane at the time of the killings. If he is found sane, he faces a maximum sentence of life in prison. If he is found insane, he will be sentenced to a state mental hospital.
